Late yesterday California Governor Jerry Brown signed legislation into law that will result in California’s medical marijuana industry being regulated at the state level for the first time since California legalized medical marijuana in 1996. It’s a bittersweet victory. On one hand, California’s industry has needed statewide regulations for a very, very long time. On the other hand, the regulations that were passed were not exactly what activists and industry members wanted. But, for better or worse, the laws are on the books now, and implementation will now move forward. I received quite a few e-mails about reactions this, so I’ll put them below. During the second Republican Debate, the topic of marijuana was brought up and Rand Paul started the discussion like this:

Fifty-six percent of Oregon voters in 2014 decided that marijuana shall be legal statewide. That’s the greatest statewide support for legalization of the four states that have passed it. Every adult may possess an ounce of marijuana, grow four cannabis plants at home, possess a half-pound of marijuana at home, and shop in safe retail outlets.

The only problem? If you live east of the Cascade Mountains, there will be no safe retail outlets for you.

The City of Oakland filed a petition on October 5 for rehearing en banc in the US Court of Appeals for the Ninth Circuit. The filing follows a federal ruling in August that Oakland couldn’t challenge the federal government’s forfeiture action in July 2012 against Harborside Health Center. The continued court case against Harborside is in violation of last year’s congressional passage of the Farr-Rohrabacher bill, which bans the use of federal funding for enforcement against state-legal medical cannabis operations.

According to the Oregon Retail Cannabis Association, the state’s dispensaries sold an estimated 11 million dollars in cannabis the first week, equaling a quarter of what the state expected to be sold in an entire year. The state estimated tax revenues of only $9 million dollars for the entire year of 2017, which amounts to about 40 million in total sales statewide. By October 7th, just one week in, Oregon sales show just how badly they underestimated the popularity of cannabis.

I always say that Texas is a tough place for marijuana reform. Unlike most other states that have voted to reform their marijuana laws, Texas does not have a citizens initiative process. In states like Oregon, where I live, citizens can gather a certain number of signatures, and put marijuana reform on the ballot. Texas does not provide its citizens that option.

To make matters worse, Texas has very harsh marijuana laws. Get caught with over four ounces, or selling over 7 grams, and you are looking at up to two years in prison and a $10,000 fine. A recent poll found that 74% of Texans support marijuana decriminalization. Per Your Houston News:

Seventy-four percent of Texas adults say the maximum punishment for being caught with pot should be changed from a criminal penalty to a ticket or fine, according to a new poll conducted by The Texas Lyceum.

Heather Fazio, Texas political director with the Marijuana Policy Project, said spending thousands of dollars prosecuting people for minor possession or consumption doesn’t make sense to taxpayers.

Some very important medical marijuana bills passed in the Michigan House of Representatives today. Those bills were HB 4209, HB 4210 and HB 4827. TWB posted an article earlier today via The Compassion Chronicles. In that article Rick Thompson had the following to say about the bills:

4209 will end all the existing dispensaries in the state and require them to get a new local and state authorization to reopen. It establishes a big government program to control growth/production/sale of marijuana to registered patients through commercial facilities. Commercial distribution of medical marijuana has been prevalent in Michigan since 2010 and is a pure market that is unregulated, robust and encompasses most of the state’s 175,000 registered patients.

Production of cannabis is already regulated through the state’s medical marijuana program. Michigan has approved approx. 30,000 licensed caregivers, who sell their extra cannabis to the dispensaries. Under the 4209 program, that all goes away. Not the caregivers, or the extra cannabis, just the safe and legal place for them to sell it. Where will people get rid of all their extra marijuana, when the dispensaries refuse to take it?

4210 re-legalizes the medical use of non-smoked forms of cannabis. It requires labels, packages, and containers for commercial production of foods, bans the use of butane extraction methods indoors, and contains penalties for failure to comply.

BOUGHT AND SOLD: HB 4827

Language in HB 4827 authorizes purchase of a computer program from California that tracks every marijuana plant commercially grown in all 82 Michigan Counties from seed to fully mature plant, and afterward. As explained by the computer program’s vendor (not the Representative who introduced the bill), their program requires extensive weighing of processed marijuana at every post-plant stage of its life.

If you have been a marijuana activist or marijuana entrepreneur for awhile, then I’m sure you have noticed the unnecessary amount of feuds and baggage that surrounds so many people in the marijuana world. ‘Hell no I won’t work with them, I hate them, and they hate me,’ is a common expression I have heard over the years. I’ve seen MANY reform efforts get hindered, and MANY business deals fizzle, simply and only because someone harbors ill will towards someone else in the marijuana world. Even when moving forward was a no-brainer, and a lot was on the line, I’ve seen people put up walls and barriers to such an extent that it has actually harmed people’s lives.

This is unacceptable to me. I get it, not everyone can get along with everyone. Wrongs have been committed against people, and it has left them very jaded. I know I personally have been wronged more times than I can count by some activists, and especially members of the marijuana industry. But that hasn’t stopped me from putting my own personal issues aside and keeping my eye on the prize.

I see this happen a lot in states like California. If activists could have banded together in California in past elections, they likely could have legalized recreational marijuana by now. But instead there is a bunch of infighting, name calling, and accusations being hurled. Hence why there are so many different initiatives in California, and in other states that are fighting for similar reform.
