Although there was a great deal of anticipation that the details of the latest federal spending bill would include a deeper level of protection in states that have legalized marijuana for medicinal and recreational purposes, the congressional machine behind the dysfunctional of the United States government has revealed that nothing will change in the next fiscal year with regards to how Uncle Sam spends money to shake the foundation of the cannabis industry.

In a last ditch effort to prevent a federal shutdown, hammer fisted negotiators for the House and Senate came to terms late Tuesday night on a $1.1 trillion spending bill intended to keep some grease in the wheels of federal operations for another year. Over half of all people admitted to drug treatment programs for marijuana-related issues over the past decade were referred there by a criminal justice source, according to a report published this month by the US Department of Health and Human Services.

In the years 2003 through 2013, 52 percent of people in drug treatment for marijuana as their ‘primary substance of abuse’ were referred by the criminal justice system. Of those, almost half (44 percent) entered treatment as a component of their probation or parole.

Only 18 percent of marijuana treatment admissions were based upon self-referrals. Primary marijuana admissions were less likely than all other drug-related admissions combined to have been self- or individually referred to treatment.

The University of Michigan’s annual Monitoring the Future (MTF) survey of teen drug use was released today and shows that softening attitudes toward marijuana and actual marijuana legalization in four states and Washington, DC, are not translating into increased teen pot smoking.

The survey also had generally good news about other drugs, reported declines in teen use of ecstasy, heroin, alcohol, cigarettes, and synthetic cannabinoids.

MTF has been tracking drug use, including alcohol and tobacco, since 1975, and surveys more than 40,000 8th, 10th, and 12th graders in some 400 public and private secondary schools across the country. The research is sponsored by the National Institutes on Drug Abuse.

The New Jersey Legislature is poised to hold the first-ever hearing on legislation clarifying employment protections for medical marijuana patients. The United States Solicitor General filed a brief yesterday urging the United States Supreme Court to dismiss a lawsuit that Nebraska and Oklahoma filed against Colorado’s marijuana legalization law. Marijuana decriminalization legislation adopted earlier this year in Delaware will officially take effect on Friday, making it the 19th state in the nation to remove the threat of jail for simple marijuana possession. (A 20th state, Missouri, has a similar law on the books that goes into effect in 2017.)

“Delaware’s marijuana policy is about to become a lot more reasonable,” said Karen O’Keefe, director of state policies for the Marijuana Policy Project. “Most people agree adults should not face jail time or the life-altering consequences of a criminal record just for possessing a substance that is safer than alcohol. Last night, Republican leadership filed legislation to fund the government for FY16. There were a number of marijuana-related provisions up for consideration in the omnibus bill. The Office of Representative Earl Blumenauer (OR-03) has reviewed the text of the legislation.

The policy championed by Representatives Dana Rohrabacher (R-CA) and Sam Farr (D-CA) that prevents the Department of Justice from interfering in the ability of states to implement legal medical marijuana laws (Division B, Title V, Section 542)

Language that supports industrial hemp research allowed under Section 7606 of the 2014 Farm Bill (Division B, Title V, Section 543 and Division A, Title VII, Section 763)

The Justice Department will continue to be prohibited from interfering in state medical marijuana laws under the new federal spending bill unveiled late Tuesday night.

The compromise legislation includes a provision that is intended to prevent the department, including the Drug Enforcement Administration, from using funds to arrest or prosecute patients, caregivers, and businesses that are acting in compliance with state medical marijuana laws. It stems from an amendment sponsored by Reps. Dana Rohrabacher (R-CA) and Sam Farr (D-CA) that was first approved in the House of Representatives in May 2014 and included in the Consolidated and Further Continuing Appropriations Act of 2015 signed by President Obama last December.

Another Florida county has joined Miami-Dade, Hallandale Beach, Key West and Broward in decriminalizing marijuana.

According to WPTV, the Palm Beach County Commissioners passed a motion 4 to 1 on Tuesday, making possession of 20 grams of pot or less a civil infraction.

The ordinance gives police the option to issue a $100 citation rather than arresting the offender. If a person is unable to pay the citation, they will be able to work it off through community service.

The measure was expected to pass after a preliminary approval by commissioners in October, but the final vote was pushed to December in order to work out the ordinance's language.

County Commissioner Priscilla Taylor, who originally proposed the measure, explained that decriminalizing the herb would ease jail overcrowding and keep pot possession charges from ruining the lives of otherwise decent and law-abiding citizens.
