While the DEA has made no apologies for its liberal interpretation of a 2014 congressional amendment that was supposed to prevent the federal government from going on full blown seek-and-destroy missions in medical marijuana states, a federal judge in San Francisco has issued a landmark ruling that could serve to neuter these vile schemes from this point forward.

On Monday, U.S. District Judge Charles Breyer slapped down the DEA with a verdict damning the agency for continuing to bust down the doors of the medical marijuana community—even when an amendment attached to last year’s government budget prevents such actions. The decision, which is reportedly the first ever by a federal judge to stand up for state marijuana laws, argues that the Rohrabacher-Farr amendment clearly prevents the Justice Department from spending money to crack skulls in states that have established medical marijuana programs.

October 1 was a very big day for marijuana consumers and dispensaries in Oregon. October 1 was the first day that dispensaries were allowed to start limited recreational marijuana sales. Many dispensaries held parties to celebrate, and some did promotions. That led to at least one dispensaries receiving a fine due to a ban on promotional giveaways. Per Oregon Live:

The state has fined a Portland marijuana dispensary $2,500 for allowing a vendor to give away marijuana concentrates and pre-rolled joints in the parking lot on the opening day of recreational marijuana sales, according to a stipulated settlement order.

The order states that Cannacea, located in Northeast Portland, allowed the giveaway of marijuana products in its parking lot and failed to check the identification of people receiving the products to ensure they were 21 or older or that they were medical marijuana patients.

The document also states the products being given away lacked proper labeling and were not in child-resistant packages.

The case represents the first disciplinary action against a dispensary since early recreational sales began Oct. 1.

Banning butane hash oil in the city of Detroit? Only Warren’s crazy Mayor Fouts would try that.

Language contained in the definitions of both the Licensing (Sec. 24-13-2) and the Zoning (Sec. 61-3-353) portions of Detroit’s proposed dispensary ordinance defines what marijuana is, and they both include the statement: “This shall not include butane hash oil.”

Normally banning anything related to marijuana use would be a legal no-go. The Michigan Medical Marihuana Act’s supremacy clause overrules local zoning ordinances (and the Michigan Home Cities Rule Act and state forfeiture laws) which would make any ban on marijuana null and void, but a Court of Appeals decision in a case known as People v Carruthers changed that protected status for concentrates and edibles.

Today, the Senate Judiciary Committee voted 15 to 5 to advance the Sentencing Reform and Corrections Act. The bill, introduced by Senator Chuck Grassley (R-IA), and sponsored by ten other Senators, would reduce mandatory minimum sentences for drug offenses, expand the federal “safety valve” (which allows judges to use their discretion to sentence people below statutory mandatory minimums), expand reentry programming and early release, and make many of the sentencing reductions retroactive.

Today is ‘Back to the Future’ Day. As an enormous Back to the Future fan, I have been waiting for this day for a long time. Gallup has conducted a poll every year since 1969 asking Americans if they support marijuana legalization. In 1969, support was at just 12%. That number has risen steadily over the years, and since 2011, a majority of Americans have answered ‘yes’ to the poll question.
