US Attorney General Expresses Support For States�?? Rights On Marijuana Policy

Unless you have lived under a rock your whole life, than you are aware that the federal government considers marijuana to be illegal in all forms. You also know that some states have legalized marijuana in medical and recreational form. This of course has led to a lot of issues and tension between the feds and states. The Obama Administration has issued some limited policy changes that has resulted in less intervention in states that have legalized.
Has the Obama Administration gone far enough? Of course not. There is still A LOT that needs to be done. But things could certainly be worse. The Obama Administration seems to at least be open to states legalizing marijuana, provided that a lot of issues are mitigated. A member of Obama’s cabinet, Attorney General Loretta Lynch, echoed that stance this last week when she did an interview for NBC. Per an article that legendary activist Tom Angell posted on Marijuana.Com:
The nation’s top cop thinks states should be allowed to legalize marijuana, but believes the federal government has a role to play in keeping cannabis away from kids and stopping interstate trafficking in the drug.

Marijuana Exhibit Coming To Oakland Museum Of California In April 2016

In April 2016, the Oakland Museum of California (OMCA) will open a new exhibition exploring marijuana, its uses, and the evolving public attitudes and complex issues surrounding it. On view in OMCA’s Great Hall, the exhibition, titled Altered State: Marijuana in California, will be the first-ever museum exhibition to focus on the topic. Designed as a catalyst for conversation and reflection, the exhibition explores the many ways that people consider marijuana, including historical, social, and political perspectives, scientific data, and opinions of a diverse range of community members and groups. Altered State will provide the opportunity for museum visitors to add their voices to the evolving conversation.
“California is on the verge of making important decisions around marijuana that will impact people living in this state,” says Kelly McKinley, Director of the OMCA Lab. “OMCA is a place where people can come together to learn, question, and add their voice to the different points of view around this topic at a very critical time in public decision making.”

Oregon started allowing limited recreational marijuana sales this past week (October 1st), and since then my Facebook feed has been inundated with pictures of people visiting dispensaries, working at dispensaries, and promoting dispensaries. Every time I log in to Facebook lately it puts a smile on my face to see the state that I was born and raised in allowing the marijuana industry to operate out in the open, instead of in the shadows like it had been for so long.
I don’t think I can ever get tired of people posting pictures of the world class Oregon flower that they bought, where they bought it from, what they thought of it, and how much they paid for it. I have spent a lot of time just scrolling and taking it all in lately. I really wish Jim Greig was here to see it all. He fought very hard to help legalize marijuana in Oregon (along with many others for sure!), and hopefully he is looking down at all of this and it is grinning from ear to ear. All Three Defendants In Kettle Falls Medical Marijuana Cultivation Case Receive Jail Sentences

Earlier today Rhonda Firestack-Harvey and Michelle Gregg were sentenced to one year and a day in connection to federal cannabis cultivation charges. Fellow defendant Rolland Gregg received a sentence of 33 months. All three were released pending appeal. In March the trio was acquitted of all crimes they were initially charged with, except for the “lesser included” charge of cannabis cultivation. The defendants were arrested in August of 2012 after the Drug Enforcement Agency seized cannabis plants on their property, which had been grown for medical purposes. They were barred from raising a medical necessity defense, despite Washington State law allowing for the cultivation of medical cannabis.
“Jail time for the Kettle Falls defendants is an embarrassment to the judicial system,” said Americans for Safe Access Executive Director Steph Sherer. “We’re calling on President Obama to pardon all three defendants immediately.”
Following the DEA raid charges were brought against Rhonda Firestack-Harvey, Rolland Gregg and Michelle Gregg as well as Larry Harvey and Jason Zucker. Charges were dropped against Larry Harvey who had been diagnosed with Stage IV terminal pancreatic cancer, but only a matter of days before the case went to trial, several months after his cancer diagnosis. Firms File Multiple Complaints Against Seattle Mayor To Protect Cannabis Patient???s Rights

Four attorneys representing three different law firms filed suit yesterday to stop Seattle Mayor Ed Murray’s crackdown on patients and purveyors in medical cannabis. They will be holding a joint press conference on September 30, 2015 at 2:00 pm at 119 1st Ave S Suite 260, Seattle, WA 98104.
Mayor Murray recently forced an Ordinance through the city council. Nick Lacata, who is not seeking reelection, introduced the Ordinance; the brain child of David Mendoza, the mayor’s pot czar. The Ordinance is the Mayor’s attempt to shutter at least 58 businesses within a month, without regard to patient access, or dispensary owners’ ability to properly conclude their business affairs.
The Ordinance threatens referral to law enforcement agencies. It effectively overrides a 2003 Ordinance, passed by the voters rather than city council, which ordered the both the city attorney and SPD to completely deprioritize cannabis enforcement. The Ordinance further threatens fines in excess of a $1000 per day against purveyors who continue to serve their patients.
The City began enforcement efforts in earnest, conducting sting operations throughout late August. Poll: Marijuana Reform Is More Popular Than Uber And Airbnb

know A LOT of people that have been going through Airbnb for all of their vacation rentals. I know even more people that have been using Uber for all of their taxi-type needs. Both companies are very popular right now, and growing in popularity every day. NBC News and the Wall Street Journal released the results of a poll they conducted which asked many questions, one of which asked people about their support for relaxing marijuana laws, and another of which asked how people felt about Airbnb and Uber (they lumped them together). The results are below, which show which percentage of respondents felt these things were ‘a step in the right direction’:

Patients Report Substituting Marijuana For Booze, Prescription Drugs

Patients who possess legal access to cannabis frequently substitute it in place of alcohol and prescription drugs, according to survey data published online in the journal Drug and Alcohol Review.
Investigators from the University of Victoria in British Columbia assessed the influence of medical marijuana access on other drug-taking behaviors in a cohort of 473 Canadian adults licensed to engage in cannabis therapy.
“Substituting cannabis for one or more of alcohol, illicit drugs or prescription drugs was reported by 87 percent of respondents, with 80.3 percent reporting substitution for prescription drugs, 51.7 percent for alcohol, and 32.6 percent for illicit substances,” they reported.
Rates of substitution were highest among respondents between the ages of 18 and 40. Patients using cannabis for pain were most likely to use pot as a substitute for prescription drugs.
Authors concluded, “The finding that cannabis was substituted for alcohol and illicit substances suggests that the medical use of cannabis may play a harm reduction role in the context of use of these substances, and could have implications for substance use treatment approaches requiring abstinence from cannabis in the process of reducing the use of other................http://www.theweedblog.com/patients-report-substituting-marijuana-for-booze-prescription-drugs/

The United States Drug Enforcement Administration (DEA) is the worst government agency of all time according to many. There have been calls by American citizens for a long time to de-fund the DEA. A lot of stories have been published lately describing some of the misconduct that goes on within the agency, the most famous of which was the stories about DEA participating in sex parties with prostitutes paid for by cartel leaders in South America.
Misconduct happens way more than the DEA would ever like to admit. But even when it does occur, very rarely does anything happen to the DEA agent(s). They go on paid administrative leave (the federal bureaucrat version of a paid vacation), and usually come back to work after they have enjoyed their time off. It sounds like even the ones that do get fired get their jobs back more often than not. Per USA Today:
The U.S. Drug Enforcement Administration has allowed its employees to stay on the job despite internal investigations that found they had distributed drugs, lied to the authorities or committed other serious misconduct, newly disclosed records show.
Lawmakers expressed dismay this year that the drug agency had not fired agents who investigators found attended “sex parties” with prostitutes paid with drug cartel money while they were on assignment in Colombia. I rail against greedy people in the cannabis industry all the time, and I feel rightfully so. There are a lot of greedy jerks in the industry, and I will continue to complain about them whenever I get a chance. But I also like to highlight situations where the opposite is occurring. There are a lot of great people in this industry, ones that are full of compassion and truly care about cannabis patients. We are seeing people like that on display right now in Northern California, where dispensaries are giving free medical marijuana to victims of fires in Northern California, an area that was hit very hard this last summer. Per the Los Angeles Times:
Medical marijuana dispensaries in Northern California are giving patients affected by a hugely destructive wildfire up to $200 in free cannabis per patient for the next week.
Through Oct. 7, two marijuana-related product companies, Care By Design and AbsoluteXtracts, are offering free products at five dispensaries in San Francisco, Santa Rosa, Sebastopol and Lake County, the companies said in a joint statement.
The companies produce cannabis oil, sprays and vaporizing cartridges, among other products.
In total, the company donated $20,000 worth of medical marijuana and medical marijuana products. That is obviously something that the companies didn’t need to do, and the dispensaries didn’t need to do. But they are doing it anyways, and that’s something that needs to be commended and celebrated. Please support the companies and dispensaries that are doing this.

Massachusetts Court Rules Cops Can�??t Search Vehicles Based Solely On Suspicion Of Marijuana Possession

Civil rights advocates and marijuana legalization supporters are welcoming a decision from the state Supreme Judicial Court that says police can’t stop motorists solely because they suspect the vehicle’s occupants are carrying marijuana. The decision came in Commonwealth v. Rodriguez.
The Rodriguez in question was Elivette Rodriguez, who was a passenger in a car stopped by New Bedford police in 2012 after they allegedly detected the smell of marijuana coming from the vehicle. During the stop, police found a bag containing 60 Percocet pills, and Rodriguez was charged with possession of a Class B substance with intent to distribute, as well as other offenses.
Before trial, Rodriguez filed a motion to suppress the evidence from the search, arguing that since the state had decriminalized the possession of small amounts of marijuana in 2008, the mere odor of marijuana coming from the car did not create sufficient probable cause to undertake the traffic stop and subsequent search. New FBI Statistics: One Marijuana Arrest Every 45 Seconds In 2014

Marijuana prohibition is one of the worst public policies in American history. Marijuana opponents will try as hard as they can to act like no one gets arrested for marijuana anymore, and therefore we should just maintain the status quo. The FBI puts out marijuana arrest statistics each year that I think every activist should point to early and often which paint a very clear picture – people are still getting arrested for marijuana all the time, and taxpayer dollars are being wasted in the process. Below are the most recent statistics, which were released by the FBI today (thanks Tom Angell for sending them over!):
* There were 700,993 marijuana arrests in the U.S. in 2014. That’s one every 45 seconds.
* Marijuana arrests comprised 44.9 percent of all drug arrests, and drug crimes are the largest category of offenses people were arrested for.
* 88.4 percent of marijuana arrests were for possession alone.

Many members of law enforcement love marijuana prohibition. It’s not because they necessarily hate marijuana, but rather they like the way marijuana prohibition makes their jobs easier. As I heard one state trooper say, ‘It gives us virtually unlimited access to search people. All I have to do is say that I suspect there is marijuana on the person or in the vehicle.’ It’s true, all police have to do is play the ‘there may be marijuana present’ and they can do just about whatever they want.
Some cops in Massachusetts have been using that tactic for years, even though Massachusetts decriminalized marijuana possession a long time ago.
