Detroit — Debra Young pulled out a handful of lighters from her glittery silver purse and smacked them on the table at Cannabis Counsel on Jefferson, then she and other activists celebrated — a few smoke alarms going off amid a dense fog — the first day of legalized recreational marijuana in Michigan.

 

“I bought a tray off Amazon of about 50 of them and they’re already disappearing,” said Young, a 61-year-old grower and caregiver from Ferndale. “I knew (the proposal to legalize marijuana) would pass because we’ve been pushing location initiatives for the last decade and when the time came, we had the knowledge, the people and almost had the money. We pulled the trigger and here we are.”

 

Colin MacDougall from Dearborn has been an active user and supporter of legalization and was a paid petitioner until this year. He said the party at Cannabis Counsel was like a celebration among friends fighting for the same cause.

 

“Came here to party and for a lot of weed to go around and some I could share with my friends, like some pre-rolled called Gorilla Glue,” said MacDougall, 28.

Illinois Gov.-elect J.B. Pritzker doubled down on adult-use cannabis legalization this week, telling reporters he thinks Illinois could be the first Midwestern state to establish a taxed-and-regulated marketplace, NPR Illinois reports.

 

Pritzker’s progressive cannabis views have raised the hopes of Illinois advocates but his latest sentiment — that the state should launch its regulated marketplace before Michigan, which legalized cannabis in the midterms via a voter referendum — goes far beyond the zeal expressed by most other pro-cannabis politicians.

While Michigan lawmakers are looking at ways to restrict the state’s voter-approved legalization initiative, Pritzker says Illinois should press the issue in the early 2019 legislative session and launch its market as quickly as possible.

While legal weed may be hard to find until it becomes commercially available in early 2020, it was only a matter of time before budding entrepreneurs came up with a way around Michigan’s new recreational marijuana law.

 

On High Road, a Boston-based online business founded and owned by Brandon Anthony, a 33-year-old Virginia native, plans to start a marijuana “gifting” service in Detroit this month.

 

Anthony will sell someone 21 or older a “munchie bag” filled with cookies or a muffin, candy or a T-shirt, for anywhere between $55 to $120. Along with the purchase of the bag: a gift of marijuana, no more than the 2.5 ounces allowed under Michigan law.

 

Under that law, the only way to get marijuana right now is to grow it, be a medical marijuana cardholder or have someone give it to you — not sell it.

ozens of drug-sniffing dogs across the United States and Canada are retiring, because their skills at detecting cannabis are no longer needed in areas with legal cannabis. The dogs can’t be un-trained to sniff out cannabis—but fortunately, most dogs retire as pets and are adopted by their handlers.

 

Following the first day of recreational cannabis sales in Canada on Oct. 17 and the recent Nov. 6 election, cannabis is legal in more areas of North America, rendering the dogs useless. Last month, 14 Canadian narcotics dogs were forced into early retirement, and replacement dogs are favored if they have no reaction to cannabis. Workers from Top Dog Police K-9 Training and Consulting in Modesto, California say they are getting more requests to omit cannabis from the dogs’ drug detection training.

 

Tulo, a yellow Labrador retriever serving on the Rifle Police Department in Colorado, will retire early in January, because his skills in detecting cannabis odor are no longer needed.

 

“A dog can’t tell you, ‘Hey, I smell marijuana’ or ‘I smell meth,’” Tommy Klein, Rifle’s police chief told The New York Times. “They have the same behavior for any drug that they’ve been trained on. If Tulo were to alert on a car, we no longer have probable cause for a search based on his alert alone.” Tulo will be replaced by dogs named Makai and Jax, who haven’t been trained to detect cannabis.

The official certification of the 2018 election results Monday begins a 10-day clock for legal weed in Michigan.

 

But even though the law doesn't take effect until Dec. 6, prosecutors in Michigan, including in Macomb and Oakland counties, are beginning to quietly dismiss low-level marijuana criminal charges that will no longer be a crime after marijuana becomes legal in the state.

 

Macomb County Prosecutor Eric Smith sent a memo to staff last week, telling assistant prosecutors to begin the process of dismissing marijuana charges, such as use or possession of small amounts of weed.

 

Likewise, Oakland County's Chief Assistant Prosecutor Paul Walton said Monday that the same is happening in Oakland.

 

There aren't many low-level cases that are handled by county prosecutors, Walton said, indicating he'd only seen three requests to dismiss so far. Most are handled by city attorneys, who enforce municipal ordinance violations.

 

Wayne County Prosecutor Kym Worthy, as well as the Michigan State Police are still weighing options for marijuana enforcement as the legalization date draws near.

 

"Now that Proposal 1 has passed, the Wayne County Prosecutor’s Office is committed to following the law regarding the prosecution of marijuana cases," Worthy said in a statement. "Overwhelmingly, the smaller marijuana cases are prosecuted by city attorneys. However, we currently have ticketed ordinance violations from the Michigan State Police that are pending review.

 

"Although the law is not retroactive, in the coming weeks we will assess the tickets that have already been charged, as well as those pending review, taking the new law into consideration," she added.

 

The state Board of Canvassers unanimously certified the Nov. 6 election results Monday afternoon, ending a four-year effort for marijuana legalization. Proponents tried in 2016, but were thwarted by technical problems in getting the necessary signatures in time. This time, the issue succeeded, both in getting enough signatures to get legal weed on the ballot and winning on Nov. 6 by a convincing 56-44 percent margin.

 

"It's a huge relief, it was a two-year process for this campaign, but there are people who have been working on this issue their entire adult lives," said Josh Hovey spokesman for the Coalition to Regulate Marijuana like Alcohol, who spearheaded the marijuana campaign.

In just the first five days of legalized recreational cannabis, the two licensed dispensaries in Massachusetts have racked up over $2 million in retail pot sales. Sales figures for the period of Nov. 20 through Nov. 25 were released on Tuesday by the state Cannabis Control Commission. The totals are for the New England Treatment Access dispensary in Northampton and Cultivate in Leicester. The stores did not report sales for the Thanksgiving holiday.

 

On Tuesday, the first day of legal sales in Massachusetts, the stores sold more than $440,000 worth of cannabis products. The busiest day for cannabis sales was Black Friday, when sales of more than 12,000 units of product generated nearly $480,000 in revenue. You’ve heard of Big Pharma and Big Tobacco. How about Big Marijuana?

 

The drug’s growing legalization is raising concerns among small-scale marijuana farmers and retailers that the corporatization of weed may be right around the corner.

 

For example, earlier this year NASDAQ became the first major U.S. stock exchange to list shares of a marijuana production company. And in August, Corona-maker Constellation Brands shocked Wall Street by making a US$3.8 billion investment in a Canadian marijuana producer, sparking a bull market in marijuana stocks industry-wide. Even Coca-Cola is exploring opportunities to get involved.

 

Corporate and Wall Street interest in weed is only going to increase now that three more states have legalized recreational or medicinal marijuana use—bringing the total to 33—while Canada recently became the second country to allow recreational use of the drug.

 

I have studied the marijuana agriculture industry for the past several years, tracing its evolution from black market drug to legal intoxicant. It’s a story I tell in my book, Craft Weed: Family Farming and the Future of the Marijuana Industry.

 

With all this money pouring in, it’s fair to wonder how legalization will change the marijuana industry itself—and whether it can stay true to its hippie roots.
