GOSHEN — Local police and prosecutors anticipate potential rises in cases of OWI, drug possession and other crimes in northern Indiana as Michigan moves to legalize marijuana for personal use.

 

Voters in Michigan passed a measure on Election Day to allow possession and retail sales of marijuana in the state. The new law is expected to take effect Dec. 6 after state election officials certify the results of the election Monday, making Michigan the first state in the Midwest and the 10th state overall to make pot legal on a recreational level.

 

Marijuana possession will be allowed on Day 1, but approving and licensing new retail establishments won’t begin until next year.

 

As Michigan decriminalizes the use of the drug, Indiana’s stance hasn’t changed. Police and prosecutors won’t hesitate to enforce state law if a person who purchased marijuana legally in Michigan possesses it illegally in Indiana.

The mayor of Northampton, Massachusetts was first in line to legally purchase marijuana at one of the town’s new dispensaries, CBS reports

 

“I think there’s a lot going on here in trying to bring marijuana out of the shadows,” Mayor David Narkewicz said.

Recreational CannabisOn May 15, a New Jersey senator introduced a bill to legalize cannabis for adults over the age of 21. Sen. Nicholas Scutari, the bill’s primary sponsor, was instrumental in drafting the New Jersey Compassionate Use Medical Marijuana Act. Prohibitive laws against cannabis are falling like dominoes from state to state and New Jersey is the latest state to introduce a recreational cannabis bill.

 

House Bill 110 would immediately decriminalize up to 50 grams of cannabis and limit fines to $100 until the legislation is ready. The bill would allow adults to possess up to one once of cannabis, 16 ounces of cannabis-infused solids, 72 liquid ounces of cannabis-infused liquids and seven grams of concentrate. Home cultivation would be explicitly forbidden. The bill would establish a Division of Marijuana Enforcement which would oversee the state’s medical cannabis program. In recent years the United States has been progressive in the legalization of marijuana. As of January 2017, almost 30 states have legalized marijuana use in some form and eight of those states (including the District of Columbia) have flat-out legalized it. But, does this allow for marijuana use in the workplace?

 

Today, one key issue to arise from the new laws is understanding marijuana use in the workplace, which has sparked new industries and specializations, like lawyers that specialize in workplace marijuana policies. There have been quite a few court cases (Coats v. Dish Network) surrounding the issue of how employers manage cannabis use by their employees; however, there aren’t as many stories surrounding marijuana use from the employer or owner of the business.
