New England Is A Marijuana Legalization Hotbed In 2016

No state east of the Mississippi has legalized marijuana, but that’s very likely to change this year, and New England will be leading the way. Two of the six New England states will likely let the voters make the call in November, while the others all have legalization bills pending.

 

So far, with the exception of Washington, DC, where voters elected to legalize the possession and cultivation, but not the sale of marijuana in 2014, all of the legalization action has been in the West. The four states that have legalized it so far—Alaska, Colorado, Oregon, and Washington—are all Western states.

 

More Western states will likely legalize it this year, including the nation’s most populous, California, as well as Arizona and Nevada. The Nevada Regulation and Taxation of Marijuana Acthas already qualified for the November ballot, while the Arizona campaign behind that’s state’s Regulation and Taxation of Marijuana Act is well-advanced in signature gathering and appears poised to easily qualify for the ballot as well.

 

Meanwhile, California’s Control, Regulate and Tax Adult Use of Marijuana Act (AUMA) is late out of the gate, but well-financed and broadly supported. It, too, should be on the ballot in November.

Virginia Senate Passes Medical Marijuana Program Improvement Bill

Yesterday, the Virginia Senate by a vote of 37 to 2 passed SB 701, a bill that would allow the production and manufacturing of Cannabidiol (CBD) oil and THC-A oil in the state. For the past several weeks patients, parents, and advocates from across the state worked tirelessly to persuade members of the Senate to move forward on this issue which until last year seemed out of reach for Virginia’s conservative legislature.

 

Last year’s passage of SB 1235 and HB 1445 gave intractable epilepsy patients and their caregivers an affirmative defense for possession of two marijuana oils, THCa and CBD used to treat seizures. However, the law provides no way for patients to obtain the oils without breaking federal and state laws. To help rectify this situation Senator Marsden from Fairfax introduced SB701 which, if passed, will provide a mechanism for production of these oils for patients with intractable epilepsy in the state.

Rhode Island Rep. Nardolillo Opposes Governor�??s Plan To Tax Medical Marijuana Plants

I saw the below press release go out from Representative Nardolillo, via Marijuana Majority’s Twitter feed:

 

In response to a proposal by Gov. Gina Raimondo to impose new fees on medical marijuana plants, Rep. Robert A. Nardolillo III (R-Dist. 28, Coventry) has voiced his opposition to the plan, calling it an unconscionable tax on sick people.

 

“The patients and caregivers who grow these plants do so because of legitimately illnesses that just happen to not respond to traditional forms of communication,” said Representative Nardolillo. “Many of these people wake up every day having to figure out how they’re going to manage they’re pain. Putting taxes on these plants is tantamount to charging people a fee to be sick.”

 

The proposal by Governor Raimondo would require a tag for each marijuana plant, charging patients $150 for each of the six plants they are allowed to cultivate. Caregivers, who can provide medical marijuana for up to five patients and cultivate up to 24 plants, would be charged $350 per plant.

 

Patients and advocates have decried the proposal, saying it would make affording the medicine an impossibility, since it isn’t covered by insurance and they can’t afford the cost of medical marijuana at the state’s three compassion centers.

 

“This proposal would certainly never fly with any other form of medication,” said Representative Nardolillo. “Can you imagine if a proposal was made to tax a specific medication? These are Rhode Islanders who are suffering.”

Cancer Patient Shares How He Illegally Healed Himself with Medical Pot

Three months ago, an unidentified Pennsylvania man's story about breaking the law to use medical marijuana went viral. Now, that man has come forward to share his identity, to give an update on his health and to deliver a message to lawmakers.

 

According to ABC27, Randal Ray Robertson, 56, was given nine to 11 months to live after being diagnosed last year with a rare bile duct cancer which spread to his lungs and liver. For the past five months, Robertson has been treating his cancer with chemotherapy and medical marijuana.

 

“Our last scan about two months ago was fantastic,” he said. “All the tumors in my lungs were gone and all the tumors in my liver had shrunk or resolved, which is unheard of almost, I guess, in this particular disease.”

 

Robertson's most recent CAT scan showed even more healing—his lungs were still clear and the small tumors in his liver had resolved even more. Georgia Sheriffs Are Sabotaging Medical Marijuana Bill

Although there was some momentum in the state legislature this session to pass a marijuana bill that would allow a statewide cultivation and distribution system to be created for patients given permission to use cannabis oil, it seems that many Georgia lawmakers are now nervous about tendering their support for the measure because state law enforcement officials have convinced them that this move will lead to an uprising in drug addiction and crime.

 

Testifying during a recent committee hearing on behalf of the Georgia Sheriffs Association, Catoosa County Sheriff Gary Sisk said that people would employ the same underhanded tactics they use now to con physicians into feeding them painkillers to get their hands on medical marijuana if the state decides to engage in cultivation. Red Tape in Legal Pot States Pushing Industry and Market into a Corner

Bans, restrictions and government red tape in states that have legalized medical and recreational marijuana are, in many cases, undermining the industry, resulting in the continuation of an active and profitable black market. This was not meant to be.

 

By burying the incipient pot industry under piles of regulations, high taxes and harassment of growers and dispensaries, governments seem to be attempting to appease the pot opponents by essentially sitting on the fence while creating obstacles.

 

The result is that these unreasonable restrictions on the burgeoning legal marijuana market are enabling illegal dealers to continue doing what they do best—operate on the black market.

 

In Washington state, the Liquor and Cannabis Board recently reported that the weed market breakdown had revealed that illegal pot sales (28 percent) closely rival legal medical (37 percent) and recreational pot sales (35 percent). And, it is assumed that figures for the illegal market are vastly under-reported.

Study: No Increase In Prevalence Of Marijuana Use Disorders

A report published last fall claiming that an estimated three in ten consumers of cannabis suffer from a ‘use disorder’ has been dismissed in a new study published in JAMA Psychiatry.

 

Investigators at the Washington School of Medicine in St. Louis assessed trends in marijuana use and the prevalence of marijuana use disorders during the years 2002 to 2013. Researchers determined that the self-reported use of cannabis by adults increased an estimated 19 percent, but that reports of cannabis-related problems actually declined during this same period.

 

“We’re certainly seeing some increases in marijuana use,” the lead researcher of the new study said. “But our survey didn’t notice any increase in marijuana-related problems. Certainly, some people are having problems so we should remain vigilant, but the sky is not falling.”

Marijuana Policy Project Unveils Details About Ohio Medical Marijuana Initiative

Ohio tried to become the first state to skip legalizing medical marijuana and go straight to full recreational marijuana legalization in 2015. That effort was soundly defeated. Immediately after the recreational marijuana legalization initiative was defeated, activists were calling for organizations to step in and put together a better effort. Marijuana Policy Project (MPP) stepped up and announced that it would be pushing for a medical marijuana initiative for the 2016 ballot. Up until today, there weren’t any details available. However, today MPP released some details, per Cleveland.Com:

 

The amendment will establish a system where patients with certain medical conditions can apply for a medical marijuana ID card that allows them to buy and possess marijuana. The state would license businesses to grow, process, test, distribute and sell medical marijuana, and sales tax would be applied. License fees and tax revenues would pay for the program’s administrative costs.

 

Kampia said patients and their caregivers could grow their own marijuana as soon as the amendment becomes law.

 

And there will not be a monopoly, a sticking point with the recreational marijuana amendment last year.

When people ask me about the first time that I smoked marijuana (1993), I always make sure to point out that I didn’t experience any euphoric effects the first time that I smoked marijuana. In fact, I didn’t feel any effects until the fourth time that I smoked marijuana. Since I had never been high prior to consuming marijuana, I didn’t know what to expect.

 

The first three times I smoked I saw my friends get high as a kite, and I was left asking myself, ‘am I high?’ I certainly didn’t feel any different, but I had clearly smoked the exact same marijuana that my friends did, and as many hits too. I inhaled deep and held it in (something that I would learn was unnecessary later in life), and did everything right. I almost didn’t smoke on that fourth attempt because I didn’t see what the benefit was.

 

But I will tell you what – that fourth time was a charm! I was smoking out of a pipe with my best friend, which led to an experience that I will never forget and will cherish for the rest of my life.
