This year has been great for weed. Canada legalized, and Mexico’s Supreme Court overturned the ban against it. Here in the U.S., Michigan said yes to recreational pot, Massachusetts started to open dispensaries and California’s booming market continued to grow. CBD became the hot new trend in health and wellness, and making sure the cannabis market will open to everyone — no matter your gender or race — took on a new importance across the country.

The seven justices on the Kansas Supreme Court ruled today that marijuana odor constitutes probable cause for police to search a private residence without a warrant, the AP is reporting. The 4-3 ruling says that an officer’s detection of a marijuana smell is enough cause to conduct a warrantless search. The case wound up in state supreme court after a lower court failed to demonstrate the lawfulness of a police search of the home of Lawrence Hubbard. During a sweep, police found roughly an ounce of cannabis in a closed container in a closet of Hubbard’s home.

 

Supreme Court Says If Police Smell Weed, They Can Search a Home Without a Warrant

Kansas police arrested Lawrence Hubbard in November 2013 after entering his apartment and discovering about 25 grams of cannabis locked inside a safe. Police also say they found a small amount of weed in a half-smoked cigarillo. In court, Hubbard’s defense attorney argued to suppress the evidence of drugs, on the grounds that the initial warrantless search violated Hubbard’s constitutional rights.

 

Furthermore, Hubbard’s defense challenged the testimony of the arresting officers as expert witnesses. Defense attorney Jim Rumsey argued “no reasonable person” would be able to detect an ounce of cannabis in a container, inside a safe, inside a closet 30 feet away from a closed apartment door.

Zixian Long was an arts student at the University of Edinburgh, in Scotland. As the fall semester came to a close last December, Long’s final term, she remembers finishing up her final projects when her mother approached her about a free travel opportunity. Long’s mother had been contacted by a person she met on the internet, who offered to pay her and her daughter’s round trip travel costs to Barcelona, if only they would bring a suitcase back with them.

 

Ignoring the warning signs, they accepted. And on their way back into Scotland, unaware that the shrink-wrapped suitcase they were carrying had more than $125,000 worth of weed in it, Border Force agents arrested them. Despite denying any knowledge of the contents of the suitcase, a jury convicted Zixian Long today on drug trafficking and drug dealing charges.

We have a national crisis, it’s not the opioid, mental health, or homeless ones but it in a way is. The landlord of the government-subsidized Niagara Towers in Niagara Falls, New York says the 78-year-old man he evicted over medical cannabis use can move back into his apartment. The happy ending to the tragic story comes less than a week after we first learned that John Flickner had been evicted from his apartment and forced to seek shelter at a nearby rescue mission.

LHP Capital, the Tennessee firm that owns and operates dozens of housing facilities across the country, including three HUD-assisted facilities in Western New York, says it is reviewing its policy on medical cannabis. At first, Flickner told reporters he didn’t want to move back to Niagara Towers. “I was just kicked out by those lovely people there, in the cold,” Flickner said. Nevertheless, Flickner did return to his apartment after his attorney, Kevin Quinn, obtained confirmation in writing that LHP would allow Flickner to use his vape pen to administer his physician-recommended medical cannabis treatments.

Flickner’s case also caught the attention of Trump administration official Lynne Patton, a HUD regional official overseeing New York and New Jersey. On Twitter, Patton wrote that state and federal law need to “catch up with medicinal marijuana usage and require private landlords to legally permit the same. Period.”

And by the time a city marshal finished reading 78-year-old John Flickner his eviction order, streetlights were just starting to flicker on. LANSING – Marijuana enthusiasts will be able to grow pot at home after all as the state Senate failed on Thursday to muster a supermajority vote to make changes to the recreational marijuana ballot proposal voters approved in the Nov. 6 election.

 

The biggest change in the bill proposed by Senate Majority Leader Arlan Meekhof, R-Grand Haven, would have dropped the provision that would allow people to grow 12 plants at home for personal use.

 

Meekhof said he wanted to prevent a flood of marijuana into neighborhoods by people growing their own pot, but by 8:30 p.m. Thursday, it became clear that he didn't have the three-quarters supermajority vote necessary to make changes to the ballot proposal.

 

"I'm very disappointed. I knew it would be a heavy lift," he said. "What we're going to be allowing to happen is going to make our society less safe."
